Mankind is the only animal which has the tendency to go against nature. Take a cow – it will never eat anything which it knows not good for its body. A carnivore won’t eat plant. In tamil language we have an adage “Puli pasithalum pul thinnathu: (Meaning however hungry it is a tiger cannot eat grass – of course the translation lacks rhyming). But take a man – his entire body structure is unfit to eat meat still he relishes it. Likewise his lungs are tuned only for oxygen rich air but look at the way he smokes his health away. In spite of heavy warning in the cigarette pockets he continues to puff and puff till the doctor comes and says no. By that time it may be too late. It is this nature of man going against nature makes him a spoil sport. Please do not argue taking my own words back. Mankind has fought nature with his mind and has come a long way from those ancient caves. The US financial system still needs at least $1 trillion to $1.2 trillion of tangible common equity to restore confidence and improve liquidity in the credit markets, Friedman Billings Ramsey analyst Paul Miller said.

Eight financial companies -- Citigroup Inc, Morgan Stanley, Goldman Sachs Group Inc, Wells Fargo & Co, JPMorgan Chase & Co, American International Group Inc, Bank of America Corp and GE Financial -- are in greatest need of capital, he said. "Debt or TARP capital is not true capital. Long-term debt financing is not the solution. Only injections of true tangible common equity will solve the current crisis," he said in a note dated November 19.

Currently, the US financial system has $37 trillion of debt outstanding, he noted. Combined, these eight companies have roughly $12.2 trillion of assets and only $406 billion of tangible common capital, or just 3.4%, the analyst said in his note to clients.

I have always maintained that you aim your retirement age at 45 so that you can enjoy life while you remain hale and healthy. I am nowhere near to that decision as yet even at 55 but to day I found a news item in Yahoo finance which tells me that a woman in Wisconsin retired from a Fortune 500 insurance firm at the age of 29!!. With utter disbelief I read the news and found that she started the habit of saving from the age of 16. That is wonderful news. Everyone in the world is pointing a finger at the West for the present day financial chaos with their non-savings attitude and I find it pleasantly consoling that a young person saves enough to retie at a very young age. May God bestow all the health on her and her family.

Come October it is the season of festivals in India and also the season of common virus fever. This is brought about by the onset on North East Monsoon which is mainly centered around the southern states. “A new study published in the Oct 24, 2008 issue of the journal Science suggests that eating lots of sulfur rich vegetables such as garlic and onions may help protect against high blood pressure or hypertension.

The study demonstrated that mice without the gene that promotes production of hydrogen sulfide experienced pronounced hypertension and diminished endothelium-dependent vasorelaxation.

For the study, Yang G from the University of Saskatchewan in Canada and other organizations knocked out the gene in lab mice that made the animal able to produce the enzyme cystathionine gamma-lyase, which controls production of hydrogen sulfide.

The researchers also found that the enzyme was activated by calcium-Calmodulin to produce hydrogen sulfide in response to vascular activation.

They concluded that these findings provide direct evidence that hydrogen sulfide H2S is a physiologic vasodilator and regulator of blood pressure.

"Now that we know hydrogen sulfide's role in regulating blood pressure, it may be possible to design drug therapies that enhance its formation as an alternative to the current methods of treatment for hypertension," said co-author Dr. Solomon H. Snyder, a neuroscientist at Johns Hopkins University.

Garlic, onions, grains, legumes, and broccoli are some of the vegetables that contain high amounts of sulfur that can be used to produce hydrogen sulfide endogenously.”

What are the duties of an advocate towards his client?

The relationship between a lawyer and a client is highly fiduciary and it is the duty of an advocate fearlessly to uphold the interests of the client by fair and honourable means without regard to any unpleasant consequences to himself or any other person.

Duty to charge reasonable fees

An advocate must charge a fee consistent with his standing at the bar and the nature of the case. The Constitution of India makes provision for the high courts to settle the table of fees payable to advocates practising before them.

An advocate must not stipulate a fee contingent on the results of litigation, or agree to share the proceeds of litigation. This is because giving the lawyer an interest in the subject matter of the suit is against professional ethics and violiative of public policy.

If he withdraws from a case, the advocate must refund any part of the fee that was not earned. However, once an advocate has accepted a case, he must under no circumstances withdraw from the same without sufficient cause and without giving reasonable and sufficient notice to the client'.

Duty to make full and frank disclosure

An advocate must, at the commencement of his engagement and during its continuation, make all full and frank disclosures to his client relating to his connection with the parties, and of any interest he may have in and, or about the controversy, as is likely to affect his client's judgment in engaging him on continuing the engagement

Duty to ensure no conflict of interest

An advocate has a duty not to accept any engagement in a trial in which he may have to give testimony, although there is no rule of evidence disqualifying counsel from giving evidence in a suit in which he is engaged. An advocate is not entitled to act in a professional capacity as well as a constituted attorney of a party in the same matter or cause. If a person appoints a firm of lawyers as his advocates, none of the partners of the lawyers' firm can act as recognized agents in pursuance of a power of attorney concerning the same cause.

An advocate who has at any time advised a party in connection with the institution of a suit, appeal or other matter or has drawn pleadings or acted for a party, must not act, appear or plead for the opposite party, unless the express consent given of all concerned is obatined, after full dislcosure of facts.

In case an advicate feels that there will be conflict of interest in filing a case on behalf of his client, his duty is to advise his client to engage some other advocate.

Duty of care to client

An advocate should ensure that the interests of the client are not in any manner hurt by his acts or omissions. He must also defend a person accused of a crime, regardless of his personal opinion as to the guilt of the accused and must not abuse or take advantage of the confidence reposed in him by the client.

When counsel does not inform the client of the subsequent proceeding of the case, he commits a breach of this duty and is therefore liable for professional negligence.

Duty to maintain confidentiality

The relation between a lawyer and a client involves the highest degree of personal trust and confidence. The Indian Evidence Act specifically provides that no lawyer is any time permitted, to disclose any communication made between the client and himself during the course of the engagemnt unless it is with his client's express permissison.

Duty to act only on clients instructions

The engagement of a lawyer comes to an end when the client becomes unable to give instructions because of his mental illness or other reasons. An advocate acting on the instructions of an agent and not the instructions of the client, commits professional misconduct.

Duty to the law

Though a lawyer has the duty to represent his client to the best of his ability, he should not neglect the fact that his loyalty is to the law. An advocate must also not be a party to fomenting of litigation. He should not suppress facts or conduct the prosecution that leads to conviction of the innocent
